Background

The Legal Advisor will provide expert guidance and support in the areas of migration services, labor law, and taxes to ensure compliance and effective legal management.

Description of Duties

Scope of Work:

  • Migration Services:
  • Advise on immigration laws, regulations, and procedures applicable to employees, including work permits, visas, and residency requirements.
  • Review and draft immigration-related documentation, such as employment contracts with foreign nationals, sponsorship agreements, and immigration compliance policies.
  • Labor Law:
  • Interpret and apply labor laws and regulations to ensure compliance in all aspects of employment, including hiring, termination, discrimination, and workplace safety.
  • Provide legal advice on employment contracts, employee benefits, workplace policies, and disputes resolution.
  • Taxes:
  • Offer guidance on tax implications related to employment, including income tax, social security contributions, and other relevant taxes.
  • Assist in tax planning strategies, compliance with tax obligations, and representation in tax disputes when necessary
  • Legal evaluation of contractual documents submitted for review, development of amendments and other proposals to them, methodological guidance of the activities of responsible executives in drafting and executing contractual documents
  • Martial Law
  • Legal support for exempting employees from conscription
  • Provide a thorough assessment of risks associated with the Martial Law
  • Internal Legal Documentation
  • Participation in the development and maintenance of internal legal documentation: procedures, regulations, orders, instructions, and other internal acts of the organization
  • External Legal Documentation
  • Participation in the development and support (including negotiations) of external legal documentation: contracts, MOUs, protocols of disagreements, claims, requests, and other similar documentation
  • Registration and Compliance
  • Legal support of any registration actions in the competent authorities of Ukraine
  • Preparation and submission of procedural documents
  • Team Support
  • Proactive support of team members while working on various legal assignments

Deliverables:

  • Provide timely and accurate legal opinions, memos, and reports on migration, labor, and tax matters as required.
  • Review and draft legal documents, agreements, and policies pertaining to the specified areas of expertise.
  • Conduct legal research to stay updated on regulatory changes and precedents affecting migration services, labor law, and taxes.

Collaboration:

  • Collaborate with internal stakeholders, including HR, finance, and management teams, to address legal issues and provide proactive legal support.
  • Liaise with regulatory authorities as necessary to represent the organization’s interests effectively.

Confidentiality:

  • Maintain strict confidentiality of all privileged and sensitive information acquired during the course of duty.

Duration and Review:

  • The initial term of engagement will be [12] months, subject to renewal based on performance and organizational needs.
  • Performance will be evaluated through periodic reviews and feedback sessions.

Requirements

  • Possess a degree in Law and be licensed to practice law in Jurisdiction.
  • Proven expertise and a minimum of 10 years of experience in providing legal advice in migration services, labor law, and tax matters.
  • Strong analytical skills, attention to detail, and ability to communicate complex legal issues effectively.
